General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions (GTC) apply to all contracts between
Nelli Vidator – NEVI Production

(hereinafter "NEVI Production") and its customers in connection with the production, provision and use of video and photo content.
2. Services
(1) NEVI Production creates video and photo productions at tournaments, camps, events and for designers, make-up artists and event organizers.
(2) The content is provided digitally – for preview via a cloud (Google Drive) and finally via a download link.
(3) There are package offers as well as individually agreed services.
(4) All delivered videos are provided in their original recording length, unless otherwise stated in the offer or product description.
3. Booking & Payment
(1) Pre-reservation:
Reservations for a video are made via a Google form. Pre-reservations do not create any payment obligations.
(2) Purchase via gallery (short and long reels):
After the tournament, the videos will be made available in a gallery. Customers who have pre-booked tickets will receive priority access. The desired videos can then be purchased via Stripe (e.g., credit card, Apple Pay, Google Pay). The respective clip number must be specified when ordering. Payment is processed immediately and encrypted via Stripe.
(3) Creative Reels:
Creative Reels are binding productions. Payment is due upon completion of the video. Clients receive a payment link (Stripe) or a payment request via email.
(4) Invoicing:
Unless a separate invoice is issued, the payment confirmation from Stripe serves as proof.
4. Cancellation
(1) The following conditions apply to cancellations at Creative Reels:
Cancellation on the same day: 100% of the agreed fee
Cancellation < 24 hours in advance: 50%
Cancellation > 24 hours in advance: 25%
(2) In case of cancellation by NEVI Production (e.g. illness, technical failures), individual compensation will be provided (e.g. voucher, rebooking).
5. Implementation & Delivery
(1) Due to the dynamics of tournaments, no guarantee can be given that all desired dances will be included.
(2) Tournament videos will be uploaded to the cloud for selection within 48 hours of the end of the tournament and delivered within 48h after purchasement. ( Creative Reels will be delivered within 14 days after purchasement.)
(3) Content remains available in the cloud for 3 weeks.
(4) If a complete dance is not possible for technical or organizational reasons, a short reel will be created automatically.
(5) Pre-booked customers receive priority access to the gallery and can purchase their videos early.
(6) If a product is purchased by mistake, the customer will be informed by NEVI Production via email about the available options.
If no response is received within 48 hours, the amount will be automatically refunded.
6. Creative Reels & Music
(1) For Creative Reels, music can be selected in advance by the customer; otherwise, NEVI Production will make the selection.
(2) Changes to the music after delivery will be charged at 25 €.
(3) No proofreading is planned. Music requests will be collected prior to production.
7. Rights of use
( 1) Customers receive a non-exclusive right to use the delivered content. They may publish the videos and photos on social media, use them for private or commercial purposes, and display them publicly. Linking to or mentioning NEVI Production is encouraged, but not required.
(2) All copyright and exploitation rights remain with NEVI Production (Nelli Vidator). NEVI Production expressly reserves the right to use the produced content itself – in particular for self-promotion (website, social media, portfolio, presentations, or showreels).
(3) Any distribution, processing or commercial third-party use by customers is only permitted with the prior written consent of NEVI Production.
(4) Upon prior agreement, the delivered material may be independently edited or modified by the client, provided that NEVI Production has given explicit consent.
8. Liability
(1) NEVI Production is not liable for failures that are beyond its control (e.g. restrictions imposed by tournament management, poor lighting conditions).
(2) In case of internal technical problems (e.g. memory card errors), a voucher will be granted as compensation.
(3) Statutory liability regulations remain unaffected.
9. Right of withdrawal for digital content
If a purchase of digital content with immediate access/download is made, the right of withdrawal expires as soon as the customer has expressly agreed that execution will begin before the expiry of the withdrawal period and has confirmed knowledge of the loss of the right of withdrawal.
